<p>According to Malyia’s parents, Ryan paced with Malyia and repeatedly asked the nurse to do something.  The ER nurse told them that Malyia had a slight fever and a rash.  Several people that came into the ER after the Jeffers arrived were treated and released.  When the dark, bruise-like patched became larger, the Jeffers approached the nurse again to no avail.  Finally, Malyia went limp in her father’s arms.</p>
<p>At that point, Ryan Jeffers pushed his way into the ER and pleaded for a doctor to help.  Malyia’s father asked the doctor “Does this look like a rash to you?” “No!” the doctor replied.  Tests showed that Malyia’s liver was failing and that she had a Streptococcus A infection commonly referred to as the flesh eating bacteria.  The long wait was nearly fatal.</p>
<p>Malyia then needed several amputations.  Her family feels these amputations would have been unnecessary if Malyia had been treated by a doctor sooner.  Malyia had both of her feet amputated, her left hand was amputated and part of her right hand, including her fingers, was amputated.</p>
<p>Even though Malyia’s parents have health insurance, their medical bills with co-pays are still astronomical.  They are also living in a room in the Ronald McDonald house, for which they pay $10 per day.</p>

<li>Irritability, sleep disturbances, fatigue</li>
</ul>
<h2><strong>How Is Whiplash Diagnosed?</strong></h2>
<p>In most cases, whiplash injuries involve soft tissues such as the discs, muscles and ligaments of the neck, and cannot be seen on X-rays. Specialized imaging tests, such as CT scans or magnetic resonance imaging (MRI) may be required to diagnose whiplash.</p>
<h2><strong>When to Seek Medical Treatment</strong></h2>
<p>The best time to seek medical treatment is immediately after a neck injury.  The risks associated with a possible neck injury are great, so it’s best not to attempt to diagnose and self-treat.  Also, if the injury was caused by a <a href="http://www.wvpersonalinjurylawyer.com/west-virginia-car-accident-lawyer" title="West Virginia Car Accident Lawyer">car accident</a>, any delay in treatment will likely be used by the insurance adjuster to minimize any property bodily injury claim you may have.  The insurance adjuster will likely argue that if you were really injured, then you would have sought immediate medical attention.</p>

<h2>Used or Hand Me Down Cribs</h2>
<p>Most crib deaths and injuries occur in used or hand me down cribs.  Although, it&#8217;s important to inspect any crib you use for your baby, a used crib requires an even more thorough inspection.  In addition, do not use older or used cribs with decorative cutouts as many of them are unsafe and may contain lead paint.  It is also important to check if these older cribs have been recalled.  You can go to <a href="http://www.cpsc.gov/cgi-bin/recalldb/model.asp ">www.cpsc.gov/cgi-bin/recalldb/model.asp </a> to determine what cribs have been recalled.</p>
<h2>Crib Design Checklist</h2>
<p>Below is a checklist to go over before placing your baby in a new or used crib:</p>
<ol>
<li><strong>Spaces between slats.</strong>  Slats should be spaced no more than 2 3/8 inches apart.  All cribs manufactured after 1974 are required to meet this safety requirement, but it&#8217;s best to measure yourself.</li>
<li><strong>Missing slats.</strong>  Missing slats can cause a number of injuries including causing the child&#8217;s head to become stuck depleting his or her oxygen, which can cause brain damage or death.</li>
<li><strong>Sharp Edges.</strong>  Many children each year are seriously injured by a crib&#8217;s sharp edges.</li>
<li><strong>Cutout areas on the headboard or footboard.</strong>  Cribs with this design are needlessly dangerous and should not be used.</li>
<li><strong>Top Rails Height.</strong>  The top rails should be at least 26 inches above the top of the mattress.</li>
<li><strong>Crib Height.</strong>  Set the mattress at its lowest position as soon as children call pull themselves up and stand.  The crib should no longer be used once the height of the top rail is less that three-fourths the child&#8217;s height.</li>
<li><strong>Missing Screws or Bolts.</strong>  This problem can cause cuts and abrasions or lead to slats popping off the crib creating the dangers mentioned above.</li>
<li><strong>Crib Hardware.</strong>  The crib&#8217;s hardware should be periodically checked, and the drop latches must be too difficult for a child to release.</li>
<li><strong>Crib Mattress.</strong>  The mattress must fit tightly into the crib so that no more than two fingers can fit between the edge of the mattress and the crib&#8217;s frame.  The mattress should be firm.</li>
<li><strong>Bedding.</strong>  Avoid soft bedding and put your baby to sleep on his or her back.</li>
</ol>

<h2><strong>Top Ten Home Playground Safety Checklist</strong></h2>
<ol>
<li>Install and maintain a shock-absorbing surface around the play equipment. For example, use at least 9 inches of wood chips, mulch or shredded rubber for play equipment up to 7 feet high. If sand or pea gravel is used, install at least a 9-inch layer of the material for play equipment up to 5 feet high.</li>
<li>Install protective surfacing at least 6 feet in all directions from play equipment. For swings, be sure the surfacing extends both in back and front to a distance twice the height of the suspending bar.</li>
<li>Never attach or allow children to attach ropes, jump ropes, strings, clotheslines or pet leashes to play equipment. Children can strangle on these.</li>
<li>Check for faulty or worn-out hardware.  For example open “S” hooks or protruding bolt ends can be hazardous.</li>
<li>Remove or securely cover sharp points or edges on the equipment, which also can be dangerous to children.</li>
<li>Check for spaces that could trap children such as openings in guardrails or between ladder rungs.  These spaces should measure less than 3.5 inches.</li>
<li>Make sure platforms and ramps have guardrails to prevent falls.</li>
<li>Remove trip hazards like tree stumps and rocks.</li>
<li>Regularly check the playground equipment to make sure it is in good condition.  All things wear out over time; playground equipment is no exception.</li>
<li>Carefully supervise children on playground equipment to make sure they are safe.</li>
</ol>

			<content:encoded><![CDATA[<p>The short answer is no.  Generally, it is the vehicle that has the insurance coverage, not the driver.  That is one of the reasons why you have to have proof of auto insurance before you can obtain a license plate for a car but you don’t need proof of insurance to obtain a driver’s license.</p>
<p>However, it’s not always that simple.  When you purchase an auto insurance policy, the insurance company also takes into account who will be driving your car when they give you a rate, and that also affects coverage should a <span style="text-decoration: underline;"><strong><a href="http://www.wvpersonalinjurylawyer.com/west-virginia-car-accident-lawyer" title="West Virginia Car Accident Lawyer">car accident</a></strong></span> occur.  If, for example, you take out a policy on your new Jeep Cherokee, and you allow your teenage daughter to drive your car even though she is not listed as an insured driver, some insurers will not allow coverage if she has an accident.</p>
<p>Why?  Your insurer asks you when you apply for a policy who will be driving your car.  You list all the drivers and tell the company how much they will be driving.  Many will hold you to that.  They will argue that you should have added your daughter as an insured driver when she started borrowing your car.</p>
<p>Of course your rate would have gone up if you did that because teenage drivers are considered risky drivers.  On the other hand, under West Virginia law, if you have auto insurance on your vehicle, it doesn’t matter who is driving your car at the time of a <span style="text-decoration: underline;"><strong><a href="http://www.wvpersonalinjurylawyer.com/west-virginia-car-accident-lawyer" title="West Virginia Car Accident Lawyer">car accident</a></strong></span>.  Your insurance policy will at least provide the minimum coverage required by West Virginia law, which is $20,000 for bodily injury.</p>
<p>In summary, there is a category of drivers called <strong>“permissive drivers”</strong>.  These are friends, neighbors, and relatives who do not reside in your household, but whom you have given permission to drive your car infrequently.  If they have an accident while driving your automobile, even if they have no coverage of their own, they are covered under your auto policy with the same policy limits that you are.  If anybody else is driving your car, such as somebody who does not have permission to drive your car or somebody who is excluded under your auto insurance policy, then they are likely only covered up to $20,000 for <strong>bodily injury</strong>.</p>

<p>To settle your claim with an insurance adjuster for a full and fair amount, it is important to remember that the insurance adjuster will value your <strong><a href="http://www.wvpersonalinjurylawyer.com/west-virginia-car-accident-lawyer" title="West Virginia Auto Accident Attorney">auto accident</a> </strong>claim (or any other insurance claim) based on the evidence we submit to them.  So, it’s important to save receipts, reports, and photographs of your injuries and property damages.  West Law Offices will obtain all of your medical records and bills and carefully review them for inaccuracies before submitting them to the adjuster.  However, it’s helpful to make periodic notes on how your injuries feel and are impacting your life.</p>

			<content:encoded><![CDATA[<p>Charleston, WV – The legislation that would decrease lawsuits and protect folks injured in accidents by requiring insurance companies to disclose how much coverage is available after an <strong>accident</strong> is now in doubt.  This is because the Senate Judiciary Committee, at the request of Sen. Clark Barnes, R-Randolph, delayed action on the bill Wednesday evening just three days before the 2012 legislation session ends.</p>
<p>As a <a href="http://www.wvpersonalinjurylawyer.com/" title="Charleston West Virginia Lawyer">Charleston, West Virginia</a><span style="text-decoration: underline;"><strong> <a href="http://www.wvpersonalinjurylawyer.com/" title="West Virginia Personal Injury Attorney">attorney</a></strong></span>, I am deeply concerned about this move by the Judiciary Committee.  This bill would have helped encourage parties to resolve <span style="text-decoration: underline;"><strong>personal injury</strong></span> claims without having to file a lawsuit.  The current law often requires attorneys to file lawsuits against the parties who caused the accident just to determine how much insurance coverage they have.</p>
<p>One of the reasons this is true is because often a party injured by the negligence of another driver doesn&#8217;t have medical insurance, but he or she needs medical care as a result of the <span style="text-decoration: underline;"><strong><a href="http://www.wvpersonalinjurylawyer.com/west-virginia-car-accident-lawyer" title="West Virginia Car Accident Lawyer">car accident</a></strong></span>.  Fortunately, some doctors will agree to treat him or her and wait to collect until after the accident claim is resolved.  However, if there is not enough insurance coverage to cover the <a href="http://www.wvpersonalinjurylawyer.com/west-virginia-car-accident-lawyer" title="West Virginia Car Accident Lawyer">car accident</a> victim’s medical care, the car accident victim is still ultimately responsible for the charges.</p>
<p>So if at the end of the case the accident victim learns that the other driver only has $20,000 in coverage, which is West Virginia’s minimum auto policy limit, and the victim has incurred $25,000 in medical bills, he must fear the doctor coming after him possibly with the use of a collections <a href="http://www.wvpersonalinjurylawyer.com/" title="West Virginia Personal Injury Attorney">attorney</a>.  Thus, before an injured party incurs medical costs, he needs to know that the negligent driver has enough insurance to cover those costs so that he can make an informed decision about whether or not to seek the medical treatment he needs.</p>
<p>If the negligent driver doesn’t have enough auto insurance to cover the accident victim’s medical expenses, the victim then has to make a tough decision: “Do I want to fully recover and then risk facing owing thousands of dollars in medical bills caused by someone else’s negligence?  Or do I want to suffer for the rest of my life with an injury that could have been fixed by medical care I couldn&#8217;t afford so that I can preserve my credit and avoid harassing bill collectors?”</p>
<p>This is a very tough decision for any person to make.  It makes it even tougher for innocent folks if an insurance carrier won’t disclose available insurance coverage.  That is why I and many other <span style="text-decoration: underline;"><strong>personal injury</strong></span> lawyers file lawsuits in situations like this.  If this Insurance Bill would pass, many of these lawsuits wouldn’t have to be filed and the underlying accident claim could be resolved more peaceably and inexpensively for all parties.  Further, it would help ease the burden folks injured in accidents already have to bear.</p>
<p>I suppose those in opposition to the bill like Jill Bentz, president of the West Virginia Insurance Federation, and the President of the West Virginia Chamber of Commerce, view this bill as a platform to advance their name and political interests.  However, in my experience, their efforts are harming those they are supposed to protect, including small businesses and the folks of West Virginia.  This is because the current law encourages costly lawsuits for the reasons set forth above, and unfortunately it’s the innocent folks injured in accidents who end up bearing the brunt of this cost.</p>

			<content:encoded><![CDATA[<p>CHARLESTON, W.Va. – Family, friends, and the Kanawha County sheriff&#8217;s department are asking for help in identifying a car involved in a fatal hit and run accident.</p>
<p>At about 11:20 p.m., January 27, a car hit and killed Dennis Glen James of Elkview.  James was crossing U.S. 119 at the Blue Creek Post Office when he was struck and killed by the car that then fled the scene, according to Lt. Sean Crosier of the Kanawha County Sheriff&#8217;s Department.</p>
<p>Deputies believe the car that hit James was either a 2005-2010 Chevrolet Cobalt or a 2007-2010 Pontiac G5. The two vehicles have identical body styles but were sold under different names.  The car may have been black.</p>
<p>Local residents and business owners are being asked to keep a look out for anyone who has recently bought driver&#8217;s side parts &#8212; including headlights, fenders or bumpers &#8212; or anyone who may have recently sold a Cobalt or G5.</p>
<p>Anyone with information about the incident is asked to call Detective David Duff at 304-357-0169. Crosier said callers may remain anonymous.</p>
